The man accused of putting “Tinkerbell the Chihuahua” inside a zipped thermal bag and leaving it in a ditch was in Busti Town court Tuesday.
According to Time-Warner Cable News, Jose Carmona Gomez was arraigned Tuesday night. He faces a misdemeanor charge for of animal cruelty. After an investigation by the Chautauqua County Humane Society, it was learned that Gomez allegedly placed the dog in a thermal bag and then abandoned it in a ditch. The dog was apparently in the bag for an extended period of time. A passer-by eventually noticed the bag and opened it, only to find Tinkerbell inside. She was treated at the humane society and will be available for adoption.
Gomez was provided paperwork for a public defender and is due back in court on Feb. 19.
