Prosecution Rests in Trial of Cheektowaga Man Accused of Attempted Murder Against Sheriff Deputy

MAYVILLE – The prosecution rested its case Thursday in the trial of Cheektowaga man who stands accused of attempted murder against a Chautauqua County Sheriff’s Office Deputy.

According to the Post-Journal, the jury in the trial for 22 year-old Justin Haffa heard testimony by a sheriff investigator involved in the case, as well has watched a video taped police interview with Haffa following his arrest last September.

Haffa is accused of allegedly trying to kill Chautauqua County Sheriff Deputy Sara Cunningham when she was running a field sobriety test on him after his vehicle went of the road on Route 60 in the town of Pomfret in the early morning of Sept. 11, 2016. Haffa is accused not following Cunningham’s directions and the incident reportedly escalated to Haffa and Cunningham wrestling on the ground, with Haffa allegedly using a knife to try and stab her. He then reportedly wrestled her gun away from her and ran from the scene. He was located and brought into custody a short time later by Chautauqua County Sheriff Joseph Gerace.

After the prosecution rested its case, public defender Ned Barone moved to have the charges dismissed against Haffa on the grounds of insufficient evidence but that request was denied by Judge David Foley.

The trial will resume Tuesday morning in Chautauqua County Court.
