$150,000 Settlement Reached in Connection to 2014 Case of Jail CO Having Sex with Inmate

MAYVILLE – Chautauqua County has reached a financial settlement with two individuals connected to the case of a former county corrections officer who had sexual contact with an inmate.

On Wednesday night the county legislature voted on an emergency resolution to pay  a settlement total of $75,000 each to Naseka Browne and Tashiany Martin. The two were involved in a civil rights lawsuit in New York Western District Court against former corrections officer Jeffrey Swan and the Chautauqua County Sheriff’s Office.

According to the resolution, the county’s insurance carrier and the county law department recommended the settlement claim $75,000 each. The money will come from the county’s liability and casualty reserve fund.

The resolution doesn’t specify the connection between either of the two plaintiffs and Swan, who was arrested in April 2014 after an investigation revealed he allegedly had sexual contact with at least one female inmate. He was suspended from his job in February 2014. Shortly afterward, he handed in his resignation. When the charges were first filed, then-district attorney David Foley indicated that the sexual contact allegedly occurred between January and February of 2014. The female inmate was a federal inmate and was transferred to another facility.

In August 2014, Swan reached a plea agreement with the DA’s office. According to current county district attorney Patrick Swanson, Swan pleaded guilty to third degree criminal sex act – a Class E felony – and was sentenced to 10 years probation.

    As a former inmate I can verify he is a pig…he exposed himself to me numerous times..its disgusting that as,women regardless of what we may have done that we are treated like pigs and he only gets probation…shame on the system

    Wasn’t he one of the guys who kidnapped and murdered that Danny Ebersole kid in Lakewood by Southwestern school back in the mid 1970’s? Why is a felon working as a c.o.?

      I too was wondering if he is the same Jeff Swan. As it turns out, Marty Whitmore was the only one charged with the kidnapping. Reportedly Swan and Williams just picked up the ransom, thinking it was for a dope deal or something.

      Yes, I remember at one time there were two Jeff Swan’s at Soutwestern. One (involved in the Ebersole tragedy) was ‘73 and another was ‘76. I assume the CO is someone entirely different. Is that correct?

    I had the same thing he forced me to fondle him as he force kissed me an fondled me he did several times while I was there in the corner hall on way to an from rec as I was in the bars when I was there also would make me come out of the bars an cell to clean at night wen he thought all were sleep an pulled me in a corner an did the same as well as on the elevator I was scared an I complied as I was in jail couldn’t do anything about it an no one would listen wen I said something I was told that I’m making it up an he told me that if I tried that again I’d be put in solitary an he can get me everyday If he wanted
